OFFICIAL RULES
NO PURCHASE NECESSARY THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES CURRENTLY RESIDING IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO) WHO ARE BETWEEN THE AGES OF SIX (6) YEARS AND TWELVE (12) YEARS OLD AT THE TIME OF ENTRY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU DO NOT RESIDE IN THE 50 UNITED STATES OR DISTRICT OF COLUMBIA.
1. HOW TO ENTER: There are two ways to enter: online or by mail. Beginning April 3, 2007, Nestlé is inviting children (ages 6-12) to try out for a chance to be a “Flavorologist for a Day” by submitting their idea for the world’s coolest frozen pop by sending their entry via mail (see details in section #2) or via online entry (see details in section #3) by visiting www.Icecream.com between April 3, 2007 at 12:00 AM (ET) through July 27, 2007 at 11:59 PM (ET) and including:
a. A Flavor Name (Create an original, fun, yet realistic name that best describes your frozen pop. Examples include Hip Hop Butterscotch or Fruit Confusion)
b. A Flavor Description (Include all the ingredients you would use to create your flavor without including any exact measurements. Describe what your frozen pop looks like in terms of color, shape, size, etc.)
c. A Flavorful Résumé (Using no more than 250 words, describe why you are qualified to be a Flavorologist, including any past experience you may have in creating –and playing– with food!)
d. Incomplete entries will be disqualified and discarded upon receipt without further consideration and without notification of entrants. All online entrants must have a valid e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account, and if a prize is won, it will be awarded to that registered user.
2. MAIL ENTRIES: All entries, regardless of whether your entry is sent via the Internet or regular mail, must be postmarked by 11:59 p.m. ET on July 27, 2007 in order to be eligible. An official entry form can also be downloaded at www.Icecream.com. Mail entries must also include the child’s name, street address, evening phone number, date of birth, and parent or guardian signature. Damaged, mutilated or otherwise illegible entries will be disqualified and discarded upon receipt without further consideration and without notification of entrants. 3. ONLINE ENTRIES: Online contest entrants must provide their valid e-mail address, first name, and frozen pop entry (see Section 1 for entry details). Online entrants will not be contacted by Nestlé Ice Cream unless the child is a potential winner. Potential winners will be contacted via a one-time e-mail communication, and the child will be instructed to have their parent/legal guardian contact a Nestlé Ice Cream representative to provide the child’s home mailing address and telephone number and the e-mail address of the parent/guardian. A Parental Permission Form ("Form") will be e-mailed to the parent/legal guardian which must be completed and signed (indicating approval) and returned by mail or fax to address/fax number provided on the Form to Sponsor within the time specified by Sponsor. If a Form is not completed and submitted within the specified time, the potential winner will forfeit his/her right to be declared a winner or win a prize. Please see our privacy policy at http://www.kids.icecream.com/privacy.html for information regarding our use of registration information. E-mail addresses of entrants and their parents/legal guardians will be discarded within one (1) year of the contest closing, and will not be utilized in that period of time for any communications from Nestlé that do not pertain to the contest. No e-mail addresses will be shared with third parties.
4. JUDGING: Judging will be completed by a panel of experts. Judging will be based on the following criteria:
The Panel will review all eligible entries and will select twenty-five (25) semi-finalists. Of the twenty-five (25) semi-finalists, ten (10) grand prize winners will be selected. All decisions of the judges shall be final and shall not be subject to any review.
5. WINNERS AND WINNER NOTIFICATION: The twenty-five (25) semi-finalists will be notified via a one-time email communication (for online entries) or a home telephone call (for mail-in entries) on or about August 6, 2007. The parent/guardian of each winner (excluding the ten (10) grand prize winners) will be required to sign and notarize an affidavit/prize acceptance/release of liability form to receive the following prize package:
From the twenty-five (25) semi-finalists, ten (10) grand prize winners will be selected and notified on or about the week of August 19, 2007 by a traceable method of mail delivery (UPS, FEDEX or registered mail). The parent/guardian of each winner will be required to sign and notarize an affidavit/prize acceptance/release of liability form to receive the following prize package:
- Total Approximate Retail Value for each semi-finalist is $100.00
- Total Approximate Retail Value for each grand prize winner is $4000.00
- Total Approximate Retail Value for [all awarded prizes] fifteen (15) semi-finalists and ten (10) grand prize winners is $41,500.00
Return of any prize or notification as undeliverable will result in disqualification and an alternate winner will be selected. Limit one prize per household or address. Federal, state and local taxes are the sole responsibility of the winner.
6. PRIZE RESTRICTIONS: Prizes are non-transferable. No substitution or cash equivalent of the prizes will be granted except at sponsor’s sole discretion. All taxes not specified are the responsibility of the winners. Sponsor reserves the right to substitute prize of equal or greater value. Limit one prize per household or address.
7. GENERAL RULES: Open only to legal residents of the United States between ages six (6) years and twelve (12) years at time of entry. Employees of Dreyer’s Grand Ice Cream, Inc. (“Sponsor”), directors, officers, affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household are not eligible. Void where prohibited by law. All federal, state, and local laws and regulations apply. By submitting an entry, you acknowledge and agree that your entry is your original work and understand that it becomes the sole and exclusive property of sponsor and its subsidiaries. Acceptance of a prize constitutes permission to sponsor and its agencies to use the winner’s first names and last initials and/or likenesses for purposes of advertising, promotion and trade without further compensation unless prohibited by law. However, the addresses, telephone numbers, and email addresses of entrants will not be sold or otherwise provided to any third parties. By participating in this contest, entrants expressly acknowledge compliance with these Official Rules, and waive all right to be compensated or reimbursed for any loss, damage or expense arising out of or in connection with participation in this contest or the acceptance, use or misuse of any prize and hold harmless, sponsor and its advertising and promotions agencies. Return of any prize notification as undeliverable will result in disqualification and an alternate winner will be selected. By participating in this promotion, entrants agree to be bound by the Official Rules. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the promotion or in the announcement of the prizes. All local, state and federal taxes will be the responsibility of the winners.
8. OTHER CONDITIONS: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this sweepstakes, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes by a technical or human errors that may occur in the processing of the entries in the sweepstakes. Sponsor reserves the right to withdraw the transmission of this sweepstakes at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Rules.
9. LIST OF WINNERS: A list of winners will be available online at www.IceCream.com or send a self-addressed-stamped envelope to “FLAVOROLOGIST WINNERS” 5929 College Avenue, Oakland, CA 94618. Requests must be received by October 25, 2007.
10. SPONSOR: Dreyer’s Grand Ice Cream, Inc. 5929 College Avenue, Oakland, CA 94618. There will be a total of fifteen (15) semi-finalist prizes and ten (10) grand prizes awarded in this contest.
